Please Read and Agree to our Trial Terms of Service Terms of Use Statement for VisionDATA VAULT Thank you for ordering the VisionDATA VAULT Backup Service. By enrolling in this service you agree to be bound by the terms and conditions listed below. If you cannot comply with these terms and conditions, please discontinue use of the VisionDATA VAULT Backup. Service Description. The Service is a computer file backup and restore service that allows users to back up and store electronic data from a designated computer offsite on a periodic basis so that Client can later restore a designated copy of the data, so long as Client continues to subscribe to the Service. Use of Service. Subject to these terms and conditions and Client’s payment of the fees for the Service set forth herein, Client may use the Service to back up data on one Designated Computer in accordance with any documentation for the Service provided by VisionAIR. Client may not transfer Client’s rights or obligations under these terms and conditions to any other party. Client receives no title or right of ownership in or to any software or other materials provided to Client in connection with the Service. All titles, including but not limited to copyrights and patent rights, in and to the Service and any software or other materials related to the Service are owned by VisionAIR or its affiliates, licensors, or suppliers. All rights not expressly granted are reserved by VisionAIR and its affiliates, licensors, and suppliers. Free Trial. Client may request, download and use the VisionDATA VAULT service for 60 days under a free, no obligation trial. Fees and Charges. After the 50th day of use of the free VisionDATA VAULT trial, Client will be contacted by a VisionAIR representative to confirm continued service of VisionDATA VAULT and to collect billing information so as to not interrupt existing backup services. Termination of Free Trial. In the event that the Client does not wish to extend use of the VisionDATA VAULT service beyond the free trial THE CLIENT WILL ASSUME THE RESPONSIBILITY TO REMOVE ANY DATA FROM VISIONDATA VAULT PRIOR TO THE END OF THE TRIAL PERIOD. Once the trial period has been exceeded any data stored on the VisionDATA VAULT server will be deleted. LIMITATIONS OF LIABILITY. CLIENT EXPRESSLY UNDERSTANDS AND AGREES THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VISIONAIR AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS OR LICENSORS WILL NOT BE LIABLE TO CLIENT FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF REVENUE, PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF VISIONAIR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (a) THE USE OR THE INABILITY TO USE THE SERVICE AND/OR SOFTWARE; (b) THE COST OF PROCUREMENT OF SUBSTITUTE SERVICE; (c) UNAUTHORIZED ACCESS TO OR ALTERATION OF CLIENT TRANSMISSIONS OR DATA; (d) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE AND/ OR SOFTWARE; (e) FAILURE TO INSURE THE COMPATIBILITY OF CLIENT’S SYSTEM (I.E., THE EQUIPMENT, DEVICES, AND SOFTWARE THAT CLIENT PROVIDE TO RECEIVE THE SERVICE) WITH THE SERVICE AND/OR SOFTWARE, OR (f) ANY OTHER MATTER RELATING TO THE SERVICE, SOFTWARE AND/OR THESE TERMS OF SERVICE. Privacy. From time to time Client may receive emails from VisionAIR but VisionAIR will not sell or otherwise distribute any information collected to third parties for solicitation purposes.
